Duties of Officers to Serve/Execute Legal Process

  1. Policy - None.
  2. Procedure
    1. Temporary Restraining Orders, Emergency Protection Orders, Lakewood Municipal Court Domestic Violence Restraining Orders, and Jefferson County or Lakewood Municipal subpoenas to testify for Fast Track Domestic Violence cases may be served anywhere for cases originating in the City of Lakewood's jurisdiction. 
    2. Restraining orders and other legal process originating from a case outside the jurisdiction of the City of Lakewood may be served if the restrained party/defendant is physically present for service. 
    3. Persons having legal process not meeting the above criteria should be referred to a private process server or the appropriate County Sheriff. 
    4. Service of legal process associated with the seizure of property (16-13-302, C.R.S.) is to be done by a police agent for cases in which the Lakewood Police Department is involved in the investigation.
