General Order 1-2.3 Agency Jurisdiction and Mutual Aid
  1. Geographic Boundaries
  2. The geographic boundaries of the department's jurisdiction, as related to G.S. §116-40.5, include all property owned or leased by the University and all streets running through or adjacent to such property. Through the written agreement with the City of Greensboro Police Department (GPD) entitled "Agreement for Police Cooperation and Jurisdiction," the territorial jurisdiction is expanded to include all of the corporate city limits of Greensboro. This expanded jurisdiction applies to officers while on-duty and includes all misdemeanor and felony offenses except for minor traffic violations. Officers shall consider their primary patrol area with authority over all offenses:

  3. Concurrent Jurisdiction
  4. The UNCG Police Department has concurrent jurisdiction with GPD in all areas identified in "Agreement for Police Cooperation and Jurisdiction" section of this policy manual. G.S. §116-40.5 allows Campus Law Enforcement Agencies to enter into mutual aid and cooperation agreements. G.S. §160A-288 allows Municipal Law Enforcement Agencies to enter into mutual aid and cooperation agreements.

    This document, and any future documents concerning concurrent jurisdiction, will include the following:

  5. Mutual Aid Agreements
  6. The Chief of the UNCG Police Department may find it necessary to enter into mutual aid agreements with other law enforcement agencies for the purpose of requesting or providing assistance for particular events or incidents requiring additional personnel. The department may enter into mutual aid agreements with other law enforcement agencies on a temporary basis under authority of G.S. §116-40.5. In any case where a mutual aid agreement is arranged, the agreement will include, at a minimum, the following terms and conditions:

    1. The legal status of agencies and agency personnel responding to mutual aid requests;
    2. Procedures for vesting provider agency personnel with the legal authority to act within the receiver agency's jurisdiction;
    3. Procedures for requesting mutual aid;
    4. Identity of those persons authorized to request mutual aid;
    5. Identity of persons to whom outside personnel are to report;
    6. Procedures for maintaining radio communications with outside personnel; and
    7. Expenditures, if any, which should be borne by the receiver agency to compensate for the use of the provider agency's resources.
  7. Jurisdiction Extension Agreement
  8. It is fundamental that UNCG clearly describes, in writing, the geographical boundaries of its jurisdiction; this can be found in the "Agreement for Police Cooperation and Jurisdiction." The intent of the jurisdiction extension agreement is to identify the agencies responsibilities, with regard to concurrent jurisdiction, which are established as a matter of law or on the basis of interagency agreement. It clearly outlines the source of the concurrent jurisdiction, e.g., cites the specific legal basis or relevant interagency agreement, and outlines such details as identification of which agency responds to a call for service by type or location, communication linkages between agencies to ensure prompt and appropriate response, provision of back-up support between jurisdictions, and reporting responsibilities and policy concerning the jurisdiction of prosecutors and courts, etc..

  9. Requests for Assistance from Federal Law Enforcement and National Guard
  10. Occasionally, it may become necessary to request assistance from federal law enforcement agencies when a major crime occurs or when a crime occurs which falls under a federal agency's jurisdiction. In those circumstances, the determination to notify these agencies will be made by the Chief of the UNCG Police Department or his designee.

    If the department, with the help of neighboring police agencies, is unable to cope with an emergency such as a riot or civil disturbance, it may become necessary to call upon the National Guard for assistance. Under these circumstances, the Chief of Police will confer with the Chancellor, who will then seek assistance from the Mayor of the City of Greensboro in requesting the National Guard.

  11. Immediate and Continuous Flight
  12. G.S. §15A-402 authorizes duly commissioned campus law enforcement officers to arrest outside their territorial jurisdiction for offenses committed in their territorial jurisdiction during the suspect's immediate and continuous flight.
